Notable Cross-Section of International and Domestic Complex/Business Litigation Matters:
– Lead trial counsel in cross-border dispute in consolidated “bet-the-company” cases involving a business divorce in an international medical device distribution company headquartered in Miami. Minority member, through fraud, stole the company’s in Latin American operating subsidiaries. After a four (4) week trial, obtained verdict in favor of LANS Medicals on all counts, including injunctive relief valued in excess of $10,000,000, together with damage awards in excess of $3,000,000. Further
obtained summary judgment on all claims and counterclaims against LANS and its managing members.
– Lead trial counsel to LBMP Holdings in a multi-decade series of disputes involving the last developable property on Miami Beach next to the Setai Hotel commonly known as the “Sea Gull” Hotel. LBMP owned the largest percentage interest in the property’s fee simple title, encumbered by multiple ground leases and sub-leases. Through the course of the cases, Mr. Alderman obtained successive dismissals of a $120,000,000 RICO claim brought against the fee-owners by sub-tenants. The cases ended upon a successful partition claims of the property’s fee owners’ reversionary interests, and Mr. Alderman’s ability to form a teaming relationship with European hoteliers to act as a $31,000,000 stalking horse for a public partition auction administered by the Honorable Michael Genden.
– Lead trial counsel for international flooring manufacturer Tarkett Industries in bellweather, first ever toxic tort claim filed against the company for benzine exposure. Mr. Alderman obtained a dismissal in favor of Tarkett after extensively building expert testimony from the country’s leading toxicologist and physician on the unique type of cancer suffered by plaintiff.
– Lead trial counsel in fraud claims brought by commercial property owner against contractor for committing $4,000,000 in fraudulent billing. Liability was established through trial, damages were determined on summary judgment.
– Lead trial counsel in real estate dispute involving multi-million dollar property on
Key Biscayne. Mr. Alderman represented the plaintiff in a specific performance
action, obtaining summary judgment, and a successful trial on damages, a second
trial on past supersedeas damages, together with attorneys’ fees award in excess
of $1,000,000.
– Lead trial defense counsel for group of directors in derivative litigation brought
by minority shareholder as a result of a series of affiliated loan transactions. Mr.
Alderman was designated by other defense counsel and the court to take the lead
on behalf of the defendants on expert witness cross-examinations at trial. Case
successfully and confidentially settled during trial
– Lead trial counsel for co-manufacturer of sports nutritional products in cross-border
dispute involving non-compliant ingredient claims brought by Brazilian distributer.
Case successfully resolved through settlement.
– Lead trial counsel in claims brought by Florida State-Chartered bank against National
bank for negligent loan servicing as a result of its the implosion of sub-servicer Law
Offices of David Stern. Case successfully and confidentially settled prior to trial.
– Lead trial counsel for National Bank in complicated insurance coverage dispute
emanating over the suspected arson of a multi-million dollar property in central
Florida. Matter resolved successfully prior to trial.
Accounting and Real Estate. Mayfield Condominium Association, Inc. v. AG-M Miami
Hotel Owner, LLC, et. al., Case No.: 18-17095-CA-44 (Fla. 11th Jud. Cir. Ct, Complex
Business Litigation). Lead trial counsel to condominium association in multi-use, air lot
litigation for 40 story hotel tower in downtown Miami. Mr. Alderman and team obtained
favorable partial summary judgment, with the matter settling on the eve of trial.
